Is Motorcycle Lane Splitting Illegal In New York?

Many of us have been stuck in traffic and thought about operating (and actually operated) our motorcycles in between cars or on the shoulder to get around traffic.  The police refer to this as “lane splitting” and in most cases its illegal in New York. 

If you’re involved in a crash, many times the other driver and the police attempt to use the “lane splitting” defense as a way to prove the motorcyclist to be at fault for his or her injuries.
