No-Fault Medical Insurance Does NOT Cover Motorcycle Accidents

Motorcycle accidents and the injuries they cause to riders and passengers are likely not covered under New York State Insurance Law Article 51 (better known as No-Fault Law).  Section 5102(f) of the No-Fault Law specifically excludes motorcycles from the definition of a “motor vehicle” for purposes of determining coverage requirements under the No-Fault Law.

However, if you are injured while operating or riding a motorcycle you are NOT required to prove you sustained a “serious injury” like those injured in car or truck accidents are required to prove.  That means that if you are not at fault for the accident when operating a motorcycle and you are injured, you are more likely to obtain a favorable recovery.

When purchasing insurance for your motorcycle, The John Wright Law Firm strongly recommends you purchase medical payment insurance, supplemental underinsured motorist (SUM) insurance of at least $100,000 and liability insurance not less than $50,000.
